The Pokémon Company and its affiliates listed below* (collectively, hereinafter “Pokémon Group”) recognize the importance of Personal Information (as defined in the “Definition of Personal Information”) and are committed to protecting Personal Information. This Privacy Policy sets forth the rules that Pokémon Group companies should comply with for the appropriate management and protection of your Personal Information and provides you with information about the Pokémon Group’s handling of Personal Information.

This Privacy Policy constitutes an agreement between you and Pokémon Group. In order to use the Pokémon Group’s products and services, you need to fully understand and agree to this Privacy Policy. By using any of the Pokémon Group’s products or services, you will be deemed to have agreed to the terms and conditions of this Privacy Policy.
If you are underage in the country or region that you reside in, you must confirm that your guardian or legal representative has read this Privacy Policy and agreed to your use of Pokémon Group’s products and services under the terms and conditions of this Privacy Policy. In the case where direct consent of your guardian or legal representative is required, you must obtain such consent on your own responsibility.
If you do not agree to this Privacy Policy, or if your guardian or legal representative does not agree to this Privacy Policy, you cannot use Pokémon Group’s products or services.
Scope of this Privacy Policy
This Privacy Policy applies to the handling of Personal Information by the Pokémon Group companies. In the event where each Pokémon Group company has a privacy policy that applies only to specific countries or regions, or specific products or services, (hereinafter “Specific Privacy Policy”) and there is any discrepancy between this Privacy Policy and the Specific Privacy Policy, the Specific Privacy Policy shall prevail.
If this Privacy Policy contains any provision for customers residing in a specific country or region, such provision shall apply.
Definition of Personal Information
The definition of “Personal Information” covered by this Privacy Policy shall be in accordance with the provisions of the Act on the Protection of Personal Information of Japan (Act No. 57 of 2003, hereinafter “Act” including any amendments or revisions thereafter) and other privacy-related laws and regulations in applicable countries and regions (hereinafter “Laws”).
“Personal Information” is defined in the Act as information relating to a living individual (i) containing a name, date of birth, or other descriptions, etc., whereby a specific individual can be identified (including those directly leading to identification of a specific individual and those which can be readily collated with other information and thereby identify a specific individual) or (ii) defined as an “individual identification code” such as fingerprint, voiceprint, etc.
In the case where this Privacy Policy applies to Personal Information of customers residing in Japan, the “Personal Information” shall include “personal data” and “retained personal data” as defined in the Act.
Policy on protecting Personal Information

3.Pokémon Group will keep Personal Information accurate and updated and appropriately discard such information without delay after achieving the purposes of use. Further, when it is required by Laws, Pokémon Group will set a retention period for Personal Information and discard without delay Personal Information whose retention period has expired.

4.Pokémon Group will strive to take any necessary and appropriate action for the security control of Personal Information including preventing any unauthorized access, leakage, falsification, loss and damage, etc.

Collection of Personal Information

1.Pokémon Group may collect from you various Personal Information, including the following items, in oral or written form or by way of photographing, recording, electromagnetic recording media, emails, input on the Internet or any other means.
Name, address, gender, age, date of birth, telephone number, fax number, email address, name of school, occupation, place of work, driver’s license number, passport number, information on the Pokémon Group’s products/services used by the customer (including user name for games, communication-related information (such as IP address), social media account, history of game play, playing method, etc.), photo/movie taken or recorded, voice, type of the Pokémon Group’s products/services ordered or purchased and purchase information such as credit card information and date of purchase, a copy of certificate of residence and the information that allows identification of a certain individual thereby. -
2.Pokémon Group will not collect any Personal Information which is particularly sensitive, such as a customer’s race, religion, social status or medical history, without the prior consent of the customer; provided that this may not be the case if otherwise required by Laws.
Purposes of use of Personal Information
Pokémon Group will use the collected Personal Information only to the extent necessary to achieve the following purposes and purposes expressly specified in advance.
Purposes of use

1.To handle order reception, settlement processing, shipment, after-the-sale service, repairs, etc., of products and services

2.To conduct drawings and selections for campaigns such as present campaigns and contests, etc., and to contact customers who have applied for such campaigns

4.To manage members of websites, online stores and email newsletters, etc., operated by Pokémon Group

5.To operate, record and announce events concerning Pokémon Group’s products and services (including Pokémon trading card game tournaments)

6.For announcement, advertisement and promotional activities concerning Pokémon Group’s products and services (including distribution of email newsletters and announcements)

7.For design, research, development or improvement of products/services as well as market research and analysis (this includes analyzing collected Personal Information, such as customer purchase information, in order to provide effective promotions and advertisements based on customer characteristics)

8.To investigate, detect, prevent, and otherwise respond to acts that violate the various terms and conditions set forth by the Pokémon Group, as well as fraud, unauthorized access, and other illegal activities.

9.To engage in any businesses ancillary or related to the above items.
Joint use of Personal Information
Pokémon Group companies may jointly use customers’ Personal Information pursuant to Laws.

Provision of Personal Information to third parties
Pokémon Group will not disclose or provide Personal Information to any third party except for any of the following cases:

1.Disclosure is made with the customer’s consent;

2.Disclosure or submission is made to the extent required by Laws;

3.Disclosure is made in a manner that does not allow identification of an individual customer, such as by statistical data;

4.Disclosure or provision is made to a contractor (including contractors outside Japan) to the extent necessary to achieve the purposes of use. In this case, Pokémon Group will perform all necessary and appropriate supervision over the contractor by taking measures such as entering into an agreement with the contractor on the handling of Personal Information.

5.Such disclosure or provision is required for the protection of life, health or property of a customer or a third party and it is difficult to obtain prior consent.
Overseas transfer
Pokémon Group may disclose or provide your Personal Information to an entity outside of Japan to the extent necessary to achieve the purposes of use specified in this Privacy Policy in any of the following cases. In such cases, the Pokémon Group will exercise necessary and appropriate supervision over the entity.

2.The entity is located in a country or region defined by the Ordinance for Enforcement of the Act as a foreign country or region that has a system for the protection of Personal Information that is deemed to be of a level equivalent to that of Japan in terms of protecting the rights and interests of individuals;

3.It is ensured that measures equivalent to those required to be taken by entities handling Personal Information under the Act are continuously implemented by entering into an agreement concerning the handling of Personal Information with such entities or by other means.
Management of Personal Information
In order to prevent leakage, loss, or damage of Personal Information collected from customers, Pokémon Group will take necessary and appropriate measures for the security control of Personal Information, including the measures listed below, and will continuously review and improve such measures.

1.Organizational Security Control Measures
Pokémon Group will appoint an information management officer, set up a department dedicated to the handling of Personal Information, and establish a response flow in the event of leakage or other incidents, as well as other organizational systems. In addition, Pokémon Group will establish internal regulations regarding the handling of Personal Information and will apply them appropriately. -
2.Personnel Security Control Measures
Pokémon Group will ensure that all employees are informed about the proper handling of Personal Information and will provide appropriate supervision and training for employees to ensure the security control of Personal Information. -
3.Physical Security Control Measures
Pokémon Group will manage the areas where Personal Information is handled, restrict the handling of Personal Information outside such areas, and prevent theft or leakage of equipment, electronic media, etc., that handle Personal Information. -
4.Technical Security Control Measures
Pokémon Group will limit the information systems that can handle Personal Information and the personnel who can use such information systems and implement appropriate access control. In addition, a system to prevent unauthorized access from outside and unauthorized software will be implemented and applied appropriately. -
5.Understanding the External Environment
When handling Personal Information in a foreign country, Pokémon Group will take necessary and appropriate measures for the security control of Personal Information, based on our understanding of the systems for the protection of Personal Information in that foreign country.
Changes to this Privacy Policy
Pokémon Group may revise this Privacy Policy at any time in order to respond to the requirements of newly applicable Laws or for other reasons. The revised Privacy Policy will be published on this webpage and shall take effect upon such publication. If you continue to use Pokémon Group’s products or services after the revision, you will be deemed to have agreed to such revised Privacy Policy.
Procedures and inquiries relating to Personal Information
You are entitled to certain rights under Laws concerning notification of purposes of use, disclosure, correction, additions, deletion, suspension of use, removal or request for suspension of provision to third parties, etc., of Personal Information obtained by Pokémon Group. When exercising your rights, you may be asked to go through identification procedures.

Cookies are used in some parts of the websites operated by Pokémon Group (hereinafter the “Websites”) for the purpose of better use of the websites. A “Cookie” refers to small pieces of data sent to your web browser at the time of accessing the website. Such data enables us to find out users’ access history to our website. No information that can identify a certain customer is contained in the information obtained by Cookies unless a customer enters such information that can identify the customer, such as by membership registration or otherwise. In the event Pokémon Group conducts direct marketing, Pokémon Group will obtain consent from you in accordance with Laws.
Notice to India Residents:
In addition to the above, with regard to the sensitive personal data or information (SPDI) as defined in the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011 issued under the Information Technology Act 2000 (e.g. credit card, debit card or other payment instrument details), the following notices are provided to India Residents.
Pokémon Group will share your SPDI to the extent permitted by Laws with the following third parties including those set forth above in “Joint Use of Personal Information” and “Provision of Personal Information to third parties”.
Pokémon Group will take reasonable security practices and procedures as required by Laws including those set forth above in “Policy on protecting Personal Information”.

Notice to Indonesia Residents:
The definition of “Personal Information” covered by this Privacy Policy and the applicable Laws shall include the provisions on personal data regulated under Indonesian laws and regulations, including Law No. 11 of 2008 on Electronic Information and Transaction as lastly amended by Law No. 19 of 2016, Government Regulation No. 71 of 2019 on Organization of Electronic Systems and Transactions, and Minister of Communication and Informatics Regulation No. 20 of 2016 on Personal Data Protection In Electronic Systems and other Indonesian relevant laws and regulations on personal data protection.
Notice to Malaysia Residents:
In addition to the above, if you are a Malaysian resident, where your Personal Information is processed in Malaysia, you may have certain additional rights with respect to the Personal Information we hold about you, including:
- right to withdraw your consent to the processing of your Personal Information;
- right to be informed via written notice on:
(a) of the data subject’s right to request access to and to request correction of the Personal Information and how to contact the data user with any inquiries or complaints in respect of the Personal Information;
(b) whether it is obligatory or voluntary for the data subject to supply the Personal Information; and
(c) where it is obligatory for the data subject to supply the Personal Information, the consequences for the data subject if he fails to supply the Personal Information. - right to access to your Personal Information held by a data user and be able to correct that Personal Information where the Personal Information is inaccurate, incomplete, misleading or not up-to-date, except where compliance with a request to such access or correction is refused under Laws.
Notice to Philippine Residents:
Pokémon Group will obtain your opt-in consent whenever necessary to the collection and processing of your Personal Information under Laws.
In addition to the above, you have the right to object to the collection and processing of your personal information at any time and to have information Pokémon Group holds about you deleted from its filing system in the absence of any other legal ground or overriding legitimate interest for the lawful processing of your Personal Information under Laws. You also have the right to ask for a copy of any Personal Information held about you, as well as to ask for correction in case there is any error or inaccuracy. You also have the right to lodge a complaint before the Philippine National Privacy Commission (“NPC”) for any violation of your rights as a data subject.
Notice to Singapore Residents:
You may, at any time, withdraw any consent given or deemed to have been in respect of the collection, use or disclosure of your Personal Information. However, please note that if you withdraw your consent to the collection, use or disclosure of your Personal Information, Pokémon Group may not be able to provide you with its products and services.
Pokémon Group will only collect National Identifiers (e.g. NRIC numbers, passport numbers, work pass numbers) from you to the extent permitted by Laws.
As to the Purposes of use of Personal Information, you will have the option of whether or not to give consent to some of the purposes i.e. purposes that are beyond what is reasonable for the provision of goods and services e.g. receiving advertisement and promotional materials, participating in research and development, etc. Notwithstanding the above, there may be certain situations where Pokémon Group will require your consent for such purposes e.g. Pokémon Group may provide offers, discounts or lucky draw opportunities to individuals that are conditional on the collection, use or disclosure of their Personal Information for specified purposes.
As to Provision of Personal Information to third parties, Pokémon Group will obtain your consent for the disclosure to third party contractors unless otherwise specified by Laws.
Where Personal Information is transferred out of Singapore, Pokémon Group will take steps to ensure that the overseas recipient is bound by legally enforceable obligations to provide the transferred Personal Information a comparable standard of protection under Laws.
Notice to Taiwan Residents:
You may choose not to provide your Personal Information with Pokémon Group. However, in such case, please note that this may result in Pokémon Group not being able to provide you with requested products or services.
